The U.S. Environmental Protection Agency's (EPA) Environmental Appeals Board (EAB) issued an opinion on November 13, 2008 in a permit proceeding before the EPA in which the challenging parties sought to force the EPA to require a limit on greenhouse gas emissions. The EAB remanded the decision to EPA for further consideration of the issue. The issue arose with respect to a proposed coal-fired power plant in Bonanza, Utah.
